Background Check

1 Malpractice Claim
  • Settlement : 2/14/2013
Nature of Complaint: INCIDENT LOCATION: DURHAM, NC /// PRACTITIONER COMMENTS: Claim related to bad result following bilateral foot surgery for bunions and metatarsal head pain. The surgery performed was not my first choice. I had recommended bilateral great toe metatarsal-phalangeal joint fusions. She rejected that, stating she wanted to preserve motion at those joints. Additionally she had severe fat pad atrophy both feet overlying the metatarsal heads which I did not believe could be improved by re-balancing the metatarsal heads via osteotomies. She also declined all non-operative measures such as orthotic devices and wearing thicker soled stiffer soled shoes. The surgeries performed were bilateral bunionectomy-osteotomies and resection of metatarsal heads 2, 3, 4, 5 both feet. The post operative results were the poorest of any foot surgeries I have ever performed with resultant severe hallux valgus deformities and recurrent callosities.
