      Nature of Complaint:

      The physician on 05-06-2009 pled guilty to Operating a Motor Vehicle Under the Influence of Drug, a Violation; Possession of a Controlled Substance, a Class D felony; Possession of a Controlled Substance, a Class A Misdemeanor; Possession of a Controlled Substance/Opiates, a Class D Felony; and Prescription Controlled Substance Not in Original Container, a Class B Misdemeanor. The physician pursuant to a plea agreement was sentenced to imprisonment for a period of five years. The sentence was diverted for a period of two years with conditions. The physician upon successful completion of the Diversion may petition the Court for expungement of the record.

      The physician also has been the subject of disciplinary action in another state.

      The West Virginia Board of Medicine on 07-13-2009 revoked the physician's license to practice medicine in the State of West Virginia.

The physician was also found guilty of Operating a motor vehicle while under the influence of drugs, Possession of a controlled substance, and Prescription controlled substance not in original container, all misdemeanors. The physician pled guilty and entered into a Diversion Agreement.

      The West Virginia Board of Medicine has Revoked the physician's license to practice medicine and surgery in the State of West Virginia effective 07-15-2009.
