Nature of Complaint: OUT OF STATE CLAIM: Indiana. A non-compliant diabetic smoker presented one day prior to aortofemoral bypass graft surgery with a septic groin. This precluded safe grafting. He had a traumatic, closed injury of the ipsilateral foot, but no rest pain or primary ischemic tissue changes. Despite aggressive antibiotics and debridement of the groin, it did not heal and the foot deteriorated. I referred the patient to the University Hospital where several weeks later he underwent BKA. He sued me as being responsible for this. Presented with the same set of circumstances I would act in exactly the same way, based on my residency and fellowship training and many years of experience. A number of surgeons of international reputation agreed to serve as witnesses on my behalf. After several years of legal meandering I agreed to comply with the recommendation of my insurance company and settle the case.
