Nature of Complaint:
The physician on approximately four occasions between July 2007 and December 2007 shared Percocet with a friend who was receiving medication from her surgeon. The physician between April 2007 and January 2008 wrote prescriptions for Lortab and Percocet PRN for a friend with pain who would share the medication with the physician. The physician also on approximately five occasions had a co-worker pick up Lortab for the physician in the co-worker's name. The physician on 03-24-2008 entered into a contract with the Kentucky Physicians Health Foundation. The physician also on 05-27-2008 entered into residential treatment at Metro Atlanta Recovery Residences, Inc. for his substance abuse problem and was successfully discharged in October 2008.
The physician while in treatment completed the "Prescribing Controlled Drugs: Critical Issues and Common Pitfalls of Misprescribing" at the University of South Florida in August 2008.
Action Taken:
The physician has entered into an Agreed Order of Indefinite Restriction with the board subject to the following terms and conditions of restriction/limitation:
- The physician's utilization of controlled substances is limited to use in hospital and out-patient surgical settings.
- The physician shall maintain a controlled substance log which the physician shall make available along with all relevant patient charts for review by the board.
- The physician shall reimburse the board for the costs of each consultant review performed.
- The physician shall be subject to at least one consultant review .
- The physician shall maintain his contractual relationship with the Kentucky Physicians Health Foundation-Impaired Physicians Program and comply with all requirements.
- The physician shall abstain from the consumption of mood-altering substances including alcohol unless prescribed by a duly licensed practitioner for a documented legitimate medical purpose.
- The physician shall be subject to random unannounced breathalyzer, blood and urine alcohol and/or drug analysis upon the board's request.
