Nature of Complaint:

The physician has been the subject of disciplinary action in another state.

The South Carolina Medical Board on 06-28-2009 issued the physician a reprimand, ordered the physician to pay a fine in the amount of $25,000.00, and suspended the physician's license to practice medicine for misconduct. The physician engaged in sexual misconduct with staff members who later became patients; performed labia examinations without gloves; falsified medical records by indicating that he had performed certain procedures when the physician's nurse had performed the procedures.

The physician's license to practice medicine in the State of South Carolina has been reinstated subject to terms and conditions.

Action Taken:

The physician has entered into a Consent Order with the North Carolina Medical Board:

  1. The physician has Surrendered his license to practice medicine in the State of North Carolina.
  2. The physician may apply for reinstatement of his license to practice medicine in the State of North Carolina when the physician has a full and unrestricted license to practice medicine in the State of South Carolina.
  3. The physician shall obey all laws and all rules and regulations involving the practice of medicine.
  4. The physician shall meet with the board for an informal interview upon the board's request.

Allegation of Complaint: Dr. Thomas Luther Roberts, III; License # 9219

Nature of Complaint:

The physician engaged in sexual misconduct twelve to fifteen years ago with two staff members who were also patients. The physician also in October and November 2007 engaged in sexual misconduct with a staff member who became a patient. The physician performed a labioplasty after improperly obtaining her consent after she had been administered one milligram of Versed. The physician also on 03-18-2008 left during a patient's surgery and allowed a nurse to complete the procedure. The physician then returned to check the results. The physician on more than one occasion falsified medical records indicating that he performed procedures when in many instances the physician's nurses performed the procedures. The physician left the operating room for long periods of time while patients were under general anesthesia. The physician began a patient's schedule procedure for a patient who was under sedation for more than eight hours. The physician on many occasions performed labia examinations on patients without wearing gloves. The physician in June 2009 submitted to an evaluation by the Behavioral Medicine Institute which recommended that the physician continue with his contract and follow recommendations.

Action Taken-Final Order

The physician has been issued a Public Reprimand by the South Carolina State Board of Medical Examiners. The board has Suspended the physician's license to practice medicine in the State of South Carolina subject to the following conditions:

  1. The physician shall pay a Fine in the amount of $25,000.00 plus costs in the amount of $1889.75 to the board.
  2. The physician shall submit proof of enrollment in a board approved ethics course .
  3. The physician shall establish and submit for board approval an in-depth plan of a practical/surgical monitoring program for the physician's practice of medicine.
The physician's license to practice medicine in the State of South Carolina upon completion of the above captioned conditions shall be Indefinitely Suspended . The suspension shall be Stayed subject to the following:
  1. The physician shall successfully complete the board approved ethics course.
  2. The physician shall maintain compliance with BMI and provide quarterly reports from BMI to the board.
  3. The physician shall submit quarterly reports to the board regarding the physician's practical/surgical monitoring program of his practice.
  4. The physician shall appear bi-annually before the board.

June 16, 2010-Order

The South Carolina Board of Medical Examiners has granted the physician's request to the extent that the monitoring requirement placed upon the physician in the previous Order is amended as follows:

  • The surgical monitoring shall be reduced to fifty percent of the physician's surgical time per month. The amount of time to be monitored by a board certified plastic surgeon shall remain at twenty-five percent of the total monitoring time. Any new monitors must be approved by the board.
