Nature of Complaint
In October of 2006 the physician was arrested for Operating Motor Vehicle Under the Influence of Alcohol and Driving in Marked Lanes and he refused to take a breathalyzer. In January of 2007 the physician was found guilty of Having Physical Control of a Vehicle While Under the Influence and subsequently has his driver’s license suspended for one year and attended an intervention program. The intervention evaluation determined the physician met the alcohol abuse criteria of “recurrent use in a manner which is physically hazardous.” The physician failed to submit to a Board- ordered 72-hour inpatient examination.
The Board has determined that there is clear and convincing evidence that the physician’s ability to practice in impaired due to the use or abuse of alcohol, drugs or other substances that impair ability to practice. The physician’s continued practice presents a danger of immediate and serious harm to the public.
Action Taken
The State Medical Board of Ohio has ordered that the physician’s certificate to practice medicine and surgery in the State of Ohio be Summarily Suspended.
09/08/2010 – Board Order
The Hearing Examiner of the State Medical Board, with regard to the recommendation sanction, notes that the physician has indicated that he is not currently interested in working with the Board regarding this matter. Thus, the Board has determined there would be no benefit in suspending the physician license to practice until he complete treatment, with terms and conditions for suspension, reinstatement, and probation during which the Board could supervise and monitor him.
The State Medical Board of Ohio has ordered that the physician’s certificate to practice allopathic medicine and surgery in the State of Ohio is Revoked.
09/21/2010 – Court Action
The physician filed a Notice of Appeal of the Board’s 09/082010 Order revoking the physician’s medical license with the Franklin county Court of Common Pleas.
11/01/2010 – Court Action
By Order the Franklin County Court of Common Pleas granted the physician’s motion to dismiss his appeal of the Board’s 09/08/2010 Order revoking the physician’s medical license.
