  Nature of Complaint:

  The physician has been convicted of a felony. The physician solicited remuneration from an individual, in return for referring individuals for the furnishing and arranging for the furnishing of home health services for which payment could be made in whole and in part under a Federal health care program, mainly Medicare.

  Action Taken:

  The Medical Board of California has Revoked the physician’s license to practice medicine and surgery in the State of California. The revocation is Stayed and the physician is placed on Probation for a period of seven years, subject, but not limited to, the following terms and conditions:

  1. The physician is suspended from the practice of medicine for 15 days, beginning the 16th day after the effective date of this decision.
  2. The physician shall successfully complete an ethics course during the first year of probation.
  3. The physician shall undergo a medical evaluation by a Board-appointed physician.
  4. The physician shall use a practice monitor.
  5. The physician is prohibited from supervising physician assistants.
  6. The physician shall obey all laws and all rules governing the practice of medicine in the State of California.
  7. The physician shall submit quarterly declarations, stating whether there has been compliance with all the conditions of probation.
  8. The physician shall comply with the Board’s probation unit.
  9. The physician shall be available for interviews with the Board.
  10. The physician shall pay all probation monitoring costs.
