    Nature of Complaint:

    The physician admitted that in December 2008 he relapsed on alcohol and did not self-report as required to the State Medical Board of Ohio until 01-08-2010. The physician further admitted during his treatment for his injuries sustained in a single car accident that he intermittently ceased consuming alcohol and in September 2009 resumed consuming alcohol on a frequent basis. The physician entered into board approved treatment in Atlanta, Georgia and remains in treatment at this center to date.

    Action Taken:

    The State Medical Board of Ohio has Indefinitely Suspended the physician's license to practice medicine and surgery in the State of Ohio not less than a period of ninety days subject to the following terms and conditions:

    1. The physician shall obey all laws.
    2. The physician shall abstain from the personal use or possession of drugs unless prescribed, dispensed or administered to the physician by another authorized by law who has full knowledge of the physician's history of chemical dependency and psychiatric condition.
    3. The physician shall abstain from alcohol.
    4. The physician shall provide written consent forms for disclosure of evaluative reports, summaries and records by any and all that provide treatment or evaluation for the physician's chemical dependency and psychiatric condition or related conditons.
    5. The physician shall submit quarterly declarations of compliance to the board.
    6. The physician shall appear before the board as required.
    7. The physician shall submit to random urine screenings for alcohol and drugs at least four times per month and ensure that all screening reports are alcohol and drug rehabilitation program no less than three times per week.
    8. The board has establised conditions for reinstatement including the requirement that the physician enter into a subsequent consent agreement incorporating probationary terms, conditons and limitations to monitor practice.

    12/08/2010 – Step II Consent Agreement

    The physician entered into a Step II Consent Agreement with the State Medical Board of Ohio in which the physician’s certificate to practice medicine and surgery in the State of Ohio shall be Reinstated. The physician voluntarily agrees to various Probationary terms, conditions and limitations including and not limited to the following.

    1. The physician shall be subject to Monitoring of Rehabilitation and Treatment including Drug Associated Restrictions and Sobriety.
    2. The physician shall be subject to Drug & Alcohol Screens which shall be conducted through a Board-approved Drug Testing Facility and Collection Site.
    3. The physician shall be subject to Mental Health Treatment.
    4. The physician shall be subject to a Monitoring Physician who shall monitor the physician and his practice and shall review patient charts.
    5. The physician shall be subject to participation in a Rehabilitation Program such as AA, NA, CA or Caduceus; and maintain continued compliance with the terms of the Aftercare contract entered into with a Board-approved treatment provider.
    6. The physician shall be subject to Required Reporting including to all employers or entities with which he is under contract to provide health care services or is receiving training.
    The physician shall not request termination of the Agreement for a minimum of five years; nor shall the physician request modification to the probationary terms, conditions and limitations for at least one year. In the event the physician violates any term or condition of the Agreement, the Board reserves the right to institute formal disciplinary proceedings.
