Nature of Complaint:
The physician on 08-04-2009 received notice that the Drug Enforcement Agency suspended the physician's DEA license prohibiting the physician from prescribing any controlled substances. The physician on 08-04-2009 authorized her former husband who is a physician to write prescriptions for controlled substances for at least five of the physician's patients with a DEA registration that had expired in March 2009. The Denton Police Department investigator on 08-05-2009 recorded a telephone conversation with the physician in which the physician acknowledged that the DEA had suspended her registration and that she had another doctor with a DEA number that was writing prescriptions to her pain patients on the physician's behalf. The Denton Police on 08-06-2009 arrested the physician and her former husband on third degree felony counts for writing controlled substance prescriptions without proper authority.
The Disciplinary Panel of the Texas Medical Board has found that the physician has violated various sections of the Medical Practices Act and based upon the evidence presented has determined that the physician's continuation in the practice of medicine presents a threat to the health, safety and welfare of the public.
The Disciplinary Panel of the Texas Medical Board has ordered the Temporary Suspension Without Notice of Hearing of the physician's license to practice medicine in the State of Texas which shall remain in effect until the board takes further action.

The Disciplinary Panel of the Texas Medical Board was unable to determine from the evidence presented that the physician is a continuing threat to the health of the physician's patients or a continuing threat to the public welfare from the acts or omissions as alleged by the board.
The board has denied the application for temporary suspension or restriction of the physician's Texas medical license with notice. This action supercedes and reverses the previous 08-19-2009 Order of Temporary Suspension Without Notice of Hearing.
