Nature of Complaint:
The physician committed gross acts of negligence, repeated acts of negligence, performed surgery at an unaccredited center, and failed to keep adequate medical records regarding the provision of services in the care and treatment of three patients.
The physician also aided or abetted the unlicensed practice of medicine for three of the physician's employees and failed to properly supervise the three medical assistants. The physician also failed to properly supervise a nurse practitioner furnisher. The physician also failed to store all drugs to be dispensed in a locked and secure storage area and allowed unauthorized staff access to the storage area and failed to maintain drug logs.
Action Taken:
The board has Revoked the physician's license to practice medicine in the State of California. The revocation is Stayed and the physician is placed on Probation for a period of three years subject to the following terms and conditions:
- The physician shall successfully complete an ethics course.
- The physician shall enroll, participate in and successfully complete all phases of the Professional Enhancement Program by the PACE Program at the University of California, San Diego School of Medicine.
- The physician shall not engage in the solo practice of medicine.
- The physician shall provide a copy of the Decision and Accusation as required.
- The physician shall not supervise physician assistants.
- The physician shall obey all laws and all rules governing the practice of medicine in the State of California.
- The physician shall submit quarterly declarations confirming probation compliance to the board.
- The physician shall appear before the board upon request.
