In lieu of formal proceedings, the physician entered into a Consent Agreement with the State Medical Board of Ohio in which the physician agrees to various terms, conditions and limitations including and not limited to the following.

The Florida Board of Medicine issued a Final Order on 10-28-2009 which resulted in a reprimand and placed restrictions on the physician's license to practice medicine in the State of Florida. The physician overcorrected a patient's right eye. Nature of Complaint:

An Administrative Complaint on 06-12-2009 was filed against the physician by the Florida Board of Medicine. The Complaint alleged that the physician failed to adequately identify the correct VISX laser setting prior to performing a photo refractive keratotomy on 07-29-2005 on a patient's right eye resulting in an overcorrection in the patient's vision in the right eye. The VISX laser printout from this treatment was excluded from the patient's medical record until 09-14-2005. The physician did not notify the patient of the treatment error until a regularly scheduled follow-up appointment on 09-22-2005. A Final Order was filed by the Florida Board of Medicine on 10-28-2009 imposing disciplinary terms.

Action Taken:

  1. The physician shall pay a fine in the amount of $500.00 within thirty days.
  2. The physician on or before 06-01-2010 shall provide written proof of the successful completion of the one hour lecture/seminar on wrong site surgeries required by the Florida Board Order.
  3. The physician on or before 10-28-2010 shall provide written proof to the Board of the successful completion of the continuing medical education in medical ethics as required by the Florida Board Order.
  4. The physician on or before 10-27-2011 shall provide written proof to the Board of having complied with the Florida discipinary condition of 250 hours of community service.
  5. The physician has been issued a public reprimand by the Board.

The physician overcorrected a patient's right eye during a photo refractive keratotomy. The physician on 07-29-2005 performed a wrong and medically unnecessary procedure on the patient by treating the patient's right eye for -7.50 -0.4 x 4 when the patient's condition required treating the right eye for -0.75 -0.4 x 8. The physician also failed to comply with the board's rule to confirm that the correct procedure and/or record when the confirmation was completed and which personnel on the surgical term confirmed each item. The physician also failed to immediately place the VISX laser printout from the first treatment in the patient's medical records; ran the VISX laser a third time to give the appearance the treatment plan was properly performed; and concealed the incident until 09-14-2005.

The physician had entered into a Counter Settlement Agreement with the Florida Board of Medicine subject to the following:

  1. The physician has been issued a Reprimand by the board.
  2. The physician shall pay a Fine in the amount of $30,000.00 plus costs in the amount of $3787.69 within thirty days.
  3. The physician shall complete the Legal and Ethical Implications in Medicine Physician's Survival Guide-Laws and Rules by the Florida Medical Association or a board approved equivalent course within eighteen months.
  4. The physician shall perform 250 hours of community service within two years.
  5. The physician shall complete five hours of continuing medical education in medical ethics within one year.
  6. The physician shall complete five hours of continuing medical education in risk management within one year.
  7. The physician shall present a lecture/seminar on wrong site surgeries to the medical staff at an approved medical facility within six months.
