    Nature of Complaint:

    The respondent tested positive for Ambien and Ethylglucuronide, Cocaine and Oxycodone. There was no evidence that a physician prescribed these substances to the respondent for a course of treatment. The Board also found that the respondent prescribed medication to his girlfriend, and diverted some of the medication for his own use. The respondent was ordered to undergo a chemical dependency evaluation and was diagnosed with cocaine and opiate abuse, alcohol abuse versus alcohol dependence and generalized anxiety disorder. The respondent was admitted for inpatient treatment and underwent assessment and detoxification and successfully completed treatment.

    Action Taken:

    It is hereby Ordered that the respondent is issued a Letter of Reprimand. The respondent is placed on probation for a period of 5 years subject to the following terms and conditions:

    1. The respondent shall submit quarterly declarations stating whether there has been compliance with all conditions of probation.
    2. The respondent shall promptly enroll in and participate in the Board’s program for the treatment and rehabilitation of physicians who are impaired by alcohol or drug abuse (MAP).
    3. The respondent shall attend MAP’s relapse prevention group therapy sessions one time per week.
    4. The respondent shall attend ninety 12-step meetings for substance abuse, approved by the Board.
    5. The respondent shall promptly obtain a PCP and shall submit the name of the physician to Board staff.
    6. Except in an emergency, the respondent shall take no medication unless the PCP or other health care provider prescribes the medication.
    7. If a controlled substance is prescribed, dispensed or is administered to the respondent, he shall notify the PCP in writing within 48 hours and notify the MAP Director immediately.
    8. The respondent shall maintain a current legible log of all medication taken by or administered to him.
    9. The respondent shall not consume alcohol or any food or other substance containing poppy seeds or alcohol.
    10. The respondent shall promptly comply with requests from Board Staff or MAP Director, to submit to witnessed biological fluid collection.
    11. The respondent shall cooperate with collection site personnel, regarding fluid collection.
    12. The respondent shall submit to mental, physical, and medical competency examinations.
    13. The respondent shall submit to all medical, substance abuse, and mental health care and treatment, ordered by the Board.
    14. The respondent shall obey all laws and all rules governing the practice of medicine in the State of Arizona.
    15. The respondent shall appear in person before the Board for interviews, upon request.
