Nature of Complaint:
The physician in his care and treatment of three patients from March 2004 to September 2008 failed to document that he established a treatment plan with specific objectives for the management of the patients chronic pain. The physician failed to periodically review and document that he independently assessed the patients progress with the treatment plan and their response to medications.
The physician failed to monitor and manage his patients use of narcotics and benzodiazepines in that the physician did not require the patients to enter into Pain Management Agreements, failed to perform pill counts, and did not perform adequate urine drug screens with sufficient frequency to ascertain medication compliance.
The physician prescribed narcotics and benzodiazepines to the three patients without making a diagnosis to support the prescriptions or performing any diagnostic studies to determine the etiology of their pain.
The physician prescribed narcotics and benzodiazepines when the physician knew that the medications were or potentially could be causing adverse side effects for patients.
The physician continuously prescribed narcotics and benzodiazepines to the three patients even though the physician knew that the patients were noncompliant with their medication regimens, abusing the medications, addicted to them, and/or possibly diverting the medications.
The physician failed to appropriately deal with patients whom the physician identified as addicted including failing to provide effective substance abuse treatment or referral for such treatment or enforcing the consequences of medication noncompliance.
The physician stated that the three patients are the only non-cancer, chronic pain patients that he is currently treating. The physician as of this date is no longer prescribing for their chronic pain and has referred them for treatment at a pain clinic and is not treating any patients for non-cancer related pain.
The physician has been issued a Reprimand by the Virginia Board of Medicine. The physician shall be limited in his practice to treating only hematology/oncology patients.
