Allegation of Complaint:

Nature of Complaint:
The Physician has been charged with substandard care and treatment of a patient, failure to arrange adequate coverage during his absence from the hospital, failure to properly monitor medication levels post-operatively and failure to address post-operative complications in a timely manner.
The patient presented to the Physician with a history of chronic C5 radiculopathy secondary to C4-5 degenerative disk and spondylosis. The Physician recommended surgery though a second opinion obtained did not find that the surgery warranted. The Physician then obtained a third opinion that concurred with the need for surgery.
The Physician performed a C4-5 anterior cervical diskectomy on the patient. On post-operatvie day 1, the patient's vital signs were stable. The patient had a temperature of 100 degrees and complained of dysphagia. On the second day, the Physician documented slow improvement with stable vital signs. The patient still had difficulty swallowing and accordng to nursing notes, complained of dizziness and had to be helped to bed.
On the third day, the patient was found cyanotic and transferred to the ICU with renal failure, liver failure and right cerebellar infarct. The Physician was out of town and the patient's care was transferred to another physician who did not receive report from the Physician about the patient. The patient appeared to be over-medicated and it was thought the cyanotic episode may have been an overdose. When the Physician returned, both physician consulted and agreed they should try to evaluate the verebrobasilar system.
The CT scan showed increasing edema and enlarged ventricles. The patient's intracranial pressure kept increasing and attempts to drain the ventricles were unsucessful.
The patient was soon declared brain dead.
The Board Revoked the Physician's license to practice medicine in the State of Texas.
October 21, 2005-Motion for Rehearing Filed
The Physician filed a motion for a rehearing.
November 14, 2005-Motion DENIED
The Board has denied the Physician's motion for rehearhing.
The Physician's license is Revoked as of November 14, 2005.
