Nature of Complaint:

The physician admitted under oath that he used individuals that he knew were not licensed as physical therapists to provide physical therapy to his patients.

A Recommended Decision was docketed in this matter on 08-23-2010. The physician and the Georgia Composite Medical Board did not request a review of the Recommended Decision. In the absence of an application to the agency for review of the Recommended Decision or an order by the Board to review the Recommended Decision on its own motion, the Recommended Decision becomes the Final Decision of the Georgia Composite Medical Board by operation of law. The Statement of Undisputed Material Facts and the Standard of Law and the Argument and Citation of Authority entered by the Administrative Law Judge are adopted and incorporated by reference herein.

Action Taken-Final Decision

The recommendation of the Administrative Law Judge is hereby made the Final Decision of the Board. Therefore, the physician is ordered to cease and desist the use of unlicensed individuals to provide physical therapy services to patients in his office; pay a fine in the amount of $5,000.00 and administrative costs in the amount of $5,000.00 within thirty days; and has been issued a public reprimand .
