Nature of Complaint
The physician has been charged with two felony counts of Theft by Deception regarding the improper use of CPT codes in Medicaid billing. The physician pled guilty to two lesser-included offences which are misdemeanors in the first degree. The physician was found guilty and sentenced to six months of incarceration on each count, which was suspended contingent on payment of restitution in the amount of $ 20,678.58 by July 2014. The physician was also placed on non-reporting probation of r 48 months. The physician’s Medicaid provider agreement has been terminated.
The State Medical Board of Ohio has ORDERED that the physician’s certificate to practice medicine and surgery in the State of Ohio shall be Indefinitely Suspended for not less than 180 days. The physician shall be subject to various terms, conditions and limitations of Interim Monitoring. Conditions for reinstatement have been established. Upon reinstatement the physician shall be subject to various Probationary terms, conditions, and limitations for a period of at least two years. The physician shall be subject to Required Reporting including to all employers or entities with which he is under contract to provide health care services or is receiving training.
The Order is effective March 22, 2011.
