Nature of Complaint
A jury of the United States District Court, Southern District of Ohio has found the physician guilty of five misdemeanor counts of Willful Failure to File Income Tax Returns. The physician has been sentenced to an aggregate term of eighteen months of imprisonment, followed by one year supervised release and restitution payment in the amount of $160,955.00. Prior to sentencing the physician apologized.
The State Medical Board of Ohio has ORDERED the that the physician’s certificate to practice osteopathic medicine and surgery in the State of Ohio shall be Indefinitely Suspended for not less than 180 days. Conditions for reinstatement have been established. Upon reinstatement, the physician shall be subject to two years of various Probationary term and conditions. The physician shall be subject to Required Reporting including to all employers or entities with which he is under contract to provide health care service or is receiving training. In the event the physician violates any term or condition of the Order, the Board may institute whatever disciplinary action it deems appropriate.
The Order is effective March 11, 2011.

By Decision on Merits of Appeal entered on August 9, 2011, the Court of Common Pleas, Franklin County, Ohio, having affirmed the Order of the State Medical Board of Ohio has dismissed this case. This is a final appealable order.
October 7, 2011 – Court Action
Notice is given that the physician appeals the Court of Appeals of Franklin County, Ohio, 10th Appellate District from the final appealable order, from the order dismissing the physician’s Administrative Appeal from the order of the Ohio State Medical Bard entered on September 12, 2011.

The State Medical Board of Ohio has granted the physician’s request for approval of an ethics course.
March 14, 2012 – Reinstatement
The State Medical Board of Ohio has approved the physician’s request for license reinstatement, subject to probationary terms, conditions and limitations established by the March 9, 2011 Board Order.
April 19, 2012 – Court Action
By Decision filed April 19, 2012, the 10th District Court of Appeals affirmed the judgment of the Franklin County Court of Common Pleas, which upheld the Board’s March 9, 2011 order indefinitely suspending the physician’s license.
