      Nature of Complaint

      The physician pled guilty and was convicted of Sexual Misconduct in December 1987 by the Fayetteville, New York Justice Court. Subsequently the physician moved to the State of Tennessee and failed to timely register with the Tennessee Sexual Offender Registry. Once the physician’s employer discovered this information, the physician was required to have a chaperone with him at all consultations with female patients; and the physician failed to comply with this policy and was subsequently terminated from his employment. Prior to his termination, the physician contracted to participate in a study of the drug Avinza. The physician entered his wife in the study, signed prescriptions for her and asked other physicians to sign for her as well.

      Between January and April 2009 the physician practiced medicine out of a single office located in a pharmacy and out of a storage unit. The physician violated the Tennessee Sexual Offender Act by establishing his medical practice within 1,000.00 feet of a child care facility. In March 2009, the physician was charged with violating the Tennessee Sexual Offender Act, a Class E Felony.

      Action Taken

      The Tennessee Board of Medical Examiners has issued a Final Order in which the physician is ORDERED to the following and is not limited to the following.

      • The physician’s medical license # 24082 shall be and is Permanently Revoked.
      • The physician shall pay all costs allowable by law associated with the prosecution of the is matter; said costs not to exceed $50,000.00.

      The Tennessee Board of Medical Examiners takes this action to protect the health, safety and welfare of Tennesseans from inappropriate behavior in the future.
