Nature of Complaint:
The physician has been the subject of disciplinary action in another state.
The Arizona Medical Board on 08-08-2008 revoked the physician's license to practice medicine in the State of Arizona.
The Hearing Committee determined that the physician committed numerous instances of negligence, gross negligence, incompetence and gross incompetence while performing spinal surgery and post-spinal surgery care.
The physician with regard to the first patient completed the surgery instead of locating the source of the patient's excessive bleeding and fixing the problem and the patient died as a result. The physician with regard to the second patient performed a posterior fusion for scoliosis and placed one screw near a lung and the other near the aorta. The physician with regard to the third patient was informed by the anesthesiologist that the patient was developing acidosis during an elective two-stage surgical fusion procedure and continued the surgical procedure to conclusion and the patient died. The physician with regard to the fourth patient severed rootlets and caused the patient to suffer a foot-drop after surgery. The physician with regard to the fifth patient did not check the patient for bowel sounds when performing anterior/posterior lumbar surgery and discharged the patient who had an obstruction in his intestines. The physician with regard to the sixth patient after surgery failed to diagnose that the patient had a cerebral spinal fluid leak for eight weeks and the patient developed bacterial meningitis. The physician with regard to the seventh patient took thirty attempts to insert a spinal cord stimulator in the patient and document the patient's neurological status for six weeks. The physician with regard to the eight patient placed a screw in the patient's back that abutted against a nerve root. The physician after surgery failed to obtain a CT scan when the patient developed radicular symptoms.

Nature of Complaint:
The physician failed to meet the standard of care of ten patients. Three patients died, two patients experienced excessive bleeding, three patients presented evidence of malpositioned screws, two patients suffered nerve injury, five patients raised issues of surgical judgment regarding whether to initiate or terminate a procedure, and five patients medical records were deficient.
The Arizona Medical Board has rejected in its entirety the Administrative Law Judge's Decision on Rehearing and has concluded that the physician's misconduct has demonstrated that the physician is unfit for a license to practice medicine in the State of Arizona.
The board has re-adopted the Findings of Fact, Conclusions of Law and Order of Revocation dated 08-08-2008.
