    Nature of Complaint:

    The physician explained to the patient that the procedure to be conducted was a right-sided decompression surgery to the patient's L4-L5 and L5-S1 spinal segments when the physician intended to perform the decompression surgery to the right and left sides of the patient's L4-L5 and L5-S1 spinal segments. The physician performed a wrong site procedure, a wrong procedure, or an unauthorized procedure by performing a decompression procedure on the left side of the patient's L4-L5 and L5-S1 spinal segments and a complete laminectomy on the patient's L5 vetebral body. The physician failed to adequately document the course of treatment provided to the patient; failed to clearly demonstrate why the course of treatment of the patient was undertaken; and/or failed to justify the course of the patient's treatment accurately.

    Action Taken-Final Order-Counter Settlement Agreement

    1. The physician has been issued a reprimand from the Florida Board of Medicine.
    2. The physician shall pay a fine in the amount of $10,000.00 within thirty days.
    3. The physician shall pay costs in the amount of $5,382.85 within thirty days.
    4. The physician shall complete the Quality Medical Record Keeping for Health Care Professionals Course sponsored by the Florida Medical Association or a Board approved equivalent within one year.
    5. The physician shall perform two hundred hours of community service within two years.
    6. The physician shall submit to a quality assurance review of the physician's medical practice to be performed by a licensed risk manager and provide the Board's Probation Committee with the quality assurance report within six months.
    7. The physician shall comply with any and all recommendations made by the risk manager and shall submit a follow-up report completed by the licensed risk manger that verifies the physician's compliance with all prior recommendations.
    8. The physician shall appear before the Board upon request.
