Dr. Andrew Benedict Silva; License # 0101229009
Nature of Complaint:
The physician was convicted of felony charges in the United States District Court for the Eastern District of Virginia, Alexandria Division of one count of Conspiracy to Defraud the United States and one count of False Statement. The physician was placed on probation for a term of two years on Counts 1 and 2, to run concurrently and subject to various conditions including payment of restitution in the amount of $16,484.00.
The Director of the Virginia Department of Health Professions has Suspended the physician's license to practice medicine and surgery in the State of Virginia.
September 23, 2010-License Reinstated
The physician's convictions were the result of bringing money that he had inherited from his mother into the United States from Switzerland in 2009. The money had remained in a Swiss bank account from 1997 until 2009 when the physician learned from family members that the Swiss bank intended to close all American accounts. The physician traveled to Switzerland to retrieve the money in October and November 2009 and sent the money back to the United States incrementally in twenty-five different packages, a violation of United States law.
The physician stated in his petition for reinstatement that his convictions resulted from the physician's failure to declare his foreign bank account to the United States Internal Revenue Service and for falsely responding to a question by a United States Customs Agent about mailing money from the account to the United States. The physician stated that he accepts full responsibility for his actions and has voluntarily forfeited the balance of the account of $211,000.00 to the United States government. The physician's probation officer told the Virginia Department of Health Professions investigator that the physician has been compliant with the terms of his court-ordered probation which began on 06-11-2010 and is scheduled to end on 06-10-2012.
The Virginia Board of Medicine has Reinstated the physician's license to practice medicine and surgery in the State of Virginia to a full and unrestricted status.
