  • Nature of Complaint: OUT OF STATE CLAIM: CA. Reported by North Carolina Medical Board INCIDENT LOCATION: SANTA CRUZ, CA PRACTITIONER COMMENTS: alleged failure to properly perform a bone marrow aspiration and biopsy, resulting in a hematoma and eventual foot drop several weeks later following a fall in her home while on supratherapeutic levels of full dose blood thinner (Warfarin). I strongly disputed this claim. I retained a well-qualified Hematology/Oncology expert who would have testified that: 1) MD performed the procedure properly and met the standard of care; 2) the patient's hematoma was not the result of any negligence; and 3) a hematoma is a recognized complication that can occur in the hands of the most experienced physician, particularly with obese patients with abundant adipose tissue obscuring all anatomical landmarks. At a mediation of this case, MD agreed to a modest settlement in order to avoid the time and cost of defe
