    Nature of Complaint:

    The Board staff charged that the physician has been using drugs in an intemperate manner that could endanger the lives of his patients, and is therefore unable to practice with reasonable skill and safety. Further, the Board staff charged that the physician violated the standard of care by his intemperate use of controlled substances while on-call for ophthalmological emergencies at Palestine Regional Medical Center.

    Action Taken:

    The Texas Medical Board has Ordered that the physician shall be subject, but not limited to, the following terms and conditions:

    1. The physician’s Texas license is hereby Suspended for nine months from the date of the entry of this Order.
    2. During the suspension, the physician shall abstain from the consumption of prohibited substances.
    3. The physician shall be solely responsible for, and promptly pay all costs and charges by any facility that conducts screens, pursuant to this Order, to determine whether he has ingested alcohol or drugs.
    4. The Board will designate a physician who is board certified in psychiatry to evaluate the physician.
    5. During any continued care and treatment, the Board shall monitor the physician’s compliance with treatment and rehabilitation.
    6. The physician shall participate in the activities and programs of Alcoholics Anonymous.
    7. The physician shall comply with all of Sante’s after-treatment care recommendations.
    8. The physician shall comply with all the provisions of the Act and other statutes regulating his practice.
    9. The physician shall fully cooperate with the Board and the Board staff.

      Nature of Complaint:

      The physician on 12-04-2009 was on-call at Palestine Regional Medical Center Emergency Room for ophthalmological emergencies. The physician was observed driving his vehicle into a utility pole in Palestine, Texas and leaving the scene of the accident in his vehicle. The physician was then involved in a second motor vehicle accident north of Palestine, Texas. The physician drove off the highway through several mailboxes, a telephone box, and head-on into a tree. The physician was pinned inside his vehicle when authorities found him. The police officers at the scene verified that the vehicle was involved in both accidents. The physician was taken to Palestine Regional Medical Center where emergency room staff found an empty one hundred milligram Demerol vial in the physician's pants pocket. The physician's toxicology screen performed at the hospital tested positive for barbituates, benzodiazepines, opiates, and PCP.

      The Panel finds that the physician is a continuing threat to the health, safety or welfare of the public.

      Action Taken:

      The Disciplinary Panel of the Texas Medical Board has Temporarily Suspended Without Notice of Hearing the physician's license to practice medicine in the State of Texas until further order of the board.

    Nature of Complaint:

    The Texas Medical Board found that the physician did not maintain adequate medical records on 21 patients. The medical records did not sufficiently detail the reasons for performing particular surgeries. The physician also admitted to self-prescribing for the treatment of muscle tension headaches, shoulder pain and sinusitis.

    Action Taken:

    The Texas Medical Board Orders that the physician shall be subject, but not limited to, the following terms and conditions:

    1. The physician shall successfully complete the medical recordkeeping course offered by the PACE program, or equivalent, within 1 year from the date of the entry of this Order.
    2. The physician shall pay an administrative penalty in the amount of $5,000, within 60 days from the date of the entry of this Order.
    3. The physician shall comply with all the provisions of the Act and other statutes regulating his practice.
    4. The physician shall fully cooperate with the Board and the Board staff.
    5. The physician shall be permitted to supervise and delegate prescriptive authority to physician assistants and advanced practice nurses, and to supervise surgical assistants.
    6. This Order shall automatically terminate upon the successful completion of the requirements listed above, in numbers 1 and 2.
