Nature of Complaint:

The Physician performed a biopsy on a patient's right breast instead of the intended left breast.

The Physician reviewed the wrong patient's chart and changed the scheduled biopsy to the right side just before the procedure. Upon completion, the Physician realized his mistake and obtained informed consent to proceed with the correct breast.

On another case, the Physician inserted a central line in the wrong patient.

The Physician failed to verify a patient's identity prior to performing the procedure.

Action Taken:

The Physician has entered into a Settlement Agreement with the Board to include the following:

  1. The Physician is issued a Letter of Concern.
  2. The Physician is issued a Fine of $15,000.00 plus costs.
  3. The Physician shall complete the Laws and Rules and Risk Management Education.
  4. The Physician shall perform 100 hours of Community Service.
  5. The Physician shall present a one hour lecture to the medical community on Wrong Site Surgeries.
